European Commission: Sweden joins and now formally participates in the European Public Prosecutor’s Office (EPPO)

ISSN: 2004-9641

The Commission has formally decided through a Commission Decision (2024/1952) that Sweden, through enhanced cooperation, that it will join and participate in the European Public Prosecutor’s Office (EPPO).

Despite the Commission’s Decision in July 2024 to confirm Sweden’s joining and formal participation in the EPPO, the operations and investigations of the EPPO do not start until twenty days after the appointment of the European Prosecutor in Sweden, which will not take place until Autumn 2024 at the earliest.

Moreover, Sweden plans a new national law, in addition to the EPPO Regulation (Regulation 2017/1939), to allow for EPPO and its prosecutors to operate in Sweden, which will include the EPPO having access to all relevant information in national databases for criminal investigations and law enforcement on the same terms as the national prosecution service.

With Sweden now within the EPPO, just three EU Member States now remain outside this form of enhanced cooperation: Denmark (though it has a parallel agreement for working arrangements), Hungary, and Ireland.

The Commission Decision (2024/1952) confirming Sweden’s joining and formal participation in the EPPO of 16 July 2024 is available here.
