Article: Paid annual leave and the compatibility of Norway’s laws with EU/EEA law

In a new article by Melanie R. Hack, Ph.D., she considers whether the Holiday Act, as contained in legislation from the 1980s, is conformity with EU/EEA law, particularly as regards the absence of paid holiday within the first year of employment.

Of the arising issues includes that of Article 31 of the Charter, the horizontal direct effect of the Working Time Directive, the social pillar of the EFTA pillar of the EEA, inter alia.

This is analysed in the broader context of the misapplication of EU/EEA law by NAV over many years.

Of note, Denmark 🇩🇰 up until recent years had similar rules on the absence of paid holiday in the first year of employment, and only as a result of EU law was in changed to a compliant manner.
