In a new article published in the Journal of European Integration called ‘The Ukraine war and the emergence of the European commission as a geopolitical actor’, Calle Håkansson of Malmö University 🇸🇪 argues that in recent times, the European Commission has had an increasing role in the EU’s foreign, security, and defence policies.
Whilst non-legal, the article is interesting given that on strict interpretation, Articke 24 TEU can be read as a delimitation on the place of the Commission in the EU’s Common Foreign and Security Policy (CFSP), and the Common Security and Defence Policy (CSDP); but this article shows how in practice, the strict word has waned a bit. In legal literature, much focus is put on the place of the Court of Justice of the European Union, whose remit in the CFSP/CSDP is also expanding; rather than the Commission. Legal literature will too require revisiting on this in time.
