Sweden is to nominate a current judge of the EU General Court, Fredrik Schalin, to be the nominee Sweden for appointment to the Court of Justice of the European Union as a judge, as per Article 253 TFEU.
He has been a judge of the General Court since 2016 (along with Ulf Öberg), and is currently the President of the Third Chamber. He was previously a référendaire to two previous judges of the CJEU also nominated by Sweden, Hans Ragnemalm and Stig von Bahr.
The Judges Proposal Board of Sweden (Domarnämnden) submits proposals of proposed judges to the government of Sweden to appoint. When it becomes to the Court of Justice of the European Union (CJEU), however, the proposal of the Judges Proposal Board leads to Sweden nominating that candidate, with the proposed person, subject to Article 255 TFEU scrutiny, subject to the appointment by the representatives of the governments of the Member States under Article 255 TFEU.
If appointed, Fredrik Schalin will take over the seat at the Court of Nils Wahl in October 2024, who is retiring. Nils Wahl has served as a Judge of the CJEU since 2019. Before that he was Advocate General (2012-2019), and a Judge of the General Court (2006-2012). He was only the second person was to have served in all three positions: a judge in both courts, and as Advocate General (the first being ). However, it is Stéphane Gervasoni, appointed a Judge of the CJEU in October 2024, will be the first ever person to have served as a judge in all three EU courts: the Court of Justice, General Court, and Civil Service Tribunal.
If approved by the Article 255 TFEU panel, Fredrik Schalin will take up the position in October 2024 at the institution’s usual October rotation. The mandate is until October 2030.
