Market Court of Finland: Bus companies submitting joint bids during a tendering process to operate public transport in Turku, is a breach of national competition law, and are fined

In the Market Court of Finland (Markkinaoikeus), it was established that public transport operators (bus companies) in Turku breached the national competition act by submitting joint bids.

This occurred during the opening up of the public transport system in Turku to private operators during a tendering procedure

According to the Finnish Competition and Consumer Authority (Kilpailu- ja kuluttajavirasto), with whom the Market Court agreed with, the bus companies eliminated all competition between them and divided the operation of the transport services among themselves following a pre-agreed plan.

The Market Court held the three joint bids constituted a prohibited co-operation between competitors and included price fixing and market sharing. Furthermore, it said that was this was a serious and systematic infringement.
