Commission: Swedish law does not adequately provide for rights of the accused

ISSN: 2004-9641

The European Commission in June 2023 sent a ‘reasoned opinion’ to Sweden for failing, in its view, to provide for a legal right to appropriate interpretation with legal counsel/representation during questioning and hearings. This, it is argued, infringes Directive (EU) 2010/64.

In this infringement procedure, Sweden has now two months to reply to the Commission, failing adequate measures made to address the Commission’s concerns, risks being referred to the Court of Justice of the European Union.
