A Belgian court has referred a case to the Court of Justice of the European Union on whether EU officials (in this case a European Commission official) have to also pay national social security contributions in Belgium for side-income relating to higher education and research, when they already must pay into an EU social security scheme connected to their main employment, given that working persons should only be subject to a single social security scheme.
The official argues that if forced to pay both EU social security contributions and national social security contributions, it could discourage persons from seeking employment within EU institutions and bodies. The legal basis of the applicant’s claim lays in the privileges and immunities granted to the EU as an international organisation.
The newly-lodged case is Case C-195/23, Partena, and you can read the referral from the national court at the following link: https://lnkd.in/eY_wr3DD
